I thought that the cut off age has been moved up? Have you reassessed? The same kind of thing happened to me when the cut off was 25 but I thought it was higher now.

I suppose the best answer to that is: you kind of can, but it is in the form of granting licenses for use. So I suppose if she wanted to go through the effort (and the seller's even wanted to enter into contracts) of granting licenses to all these people, it may work.

Not really, or at least, not as the law current stands. You can't really parse things out. In order to maintain a valid trademark you have to actively work to keep it yours and only yours, and if you don't, it's basically a defense that you've abandoned it.

If you let the little people skate, then when the big guy (who does pose a threat to you commercially) infringes, and you bring suit, they bring up a whole host of reasons why you didn't adequately protect your trademark because you knew that these 100 people were using it and

I don't know a ton about trademark (not my area of the law) but what I do know is this: if you want to keep a trademark, you have to make an effort to protect it. If you trademark something you can't, say, keep all the big guys from using it but let the little guys do what they will. The law just doesn't work that

I know; totally crazy. I may be making this up, too (it was several years ago) but I seem to recall that either the defendant or the co-worker were relatively new to the job; like, they hadn't been working together all that long. Discretion was not a trait this guy had.
