It depends on the reasons for the failure. If the failure is due to them simply disregarding the order, they could be held in contempt of court. If there are other, legitimate reasons for their failure to comply (for instance, the parent was released and has gone underground, so that they cannot find him or her), then…

I honestly think the main reason DHS is fucked is because it’s named the Department of Homeland Security and that entire concept just inflated the goddamn heads of everyone working there into thinking they’re the last lines of defense, etc...

First, when everyone is complaining about ICE, they’re actually complaining about ICE ERO (Enforcement and Removal Operations).

One major advantage to the “inefficiencies” of putting ICE under the control of a larger immigration-related department is that it forces ICE to consider immigration as a whole, and not solely from the metric of enforcement.
