They’re obviously going to use Scalia’s interpretation, per the Court’s decisions in Heller and McDonald, respectively. I think (as clearly you do,) that that’s basically just intellectual gymnastics, and that the interpretation in Stevens’ dissent is probably closer to an accurate interpretation of the text.
