I understand the outrage and I sympathize with Eric. No one deserves to be bullied and/or harassed, no one deserves the kind of awful abuse he no doubt endured. However, he threw the first punch, in response to something said verbally. That equals an assault and battery charge.
he was verbally bullied, which isn't right - I'm not saying the guy who kicked his ass was right in this situation and a victim. But justice is not so cut and dry, sorry. More than one person can be wrong in a situation - he made a conscious decision to escalate a problem to a physical level.
I'll be that guy. It doesn't matter if he was unevenly matched or not, he started the PHYSICAL altercation - assault charges in a perfect system would still charge him with being the instigator.

Except you don't know the context either. There is no indication that the alleged victim has a history of receiving physical abuse from these people. All we know is that he struck first (fact) and threatened the school (fact).

I think looking to build a case from "Look, I know these kinds of kids", is a problem. It really needs to be "Look, I know [] these kids." They may well be EXACTLY the kind of vicious, malignant kids you go on to describe. But I can't see how you can make the case without some preceding behaviours or actions from them…
Listen, as horrible as this is, you can't respond to words with violence. It is just not okay. I can't tell you the number of times people have said things to me that made me want to bash their teeth in. I didn't do it because that is not how civil society works.
