Agreed 100%. Maybe the accused cannot be unambiguously called the perpetrator until after trial, but even if they got the wrong person (or people, the sociopaths) the victim was still raped. It goes back to the “Sorry sir, are you SURE you were killed?” discussion of how this does not happen for other crimes.
