Slippi doesn’t even enter into it really, US copyright law is pretty clear that hosting a tournament or streaming a game is a public performance which is an exclusive right of the copyright holder. Nintendo can legally shut down any public tournament of any game they hold the rights to.

That actually IS how it works. Failing to enforce a copyright can lead to negative judgments against the holder down the road. If a copyright violator can prove that you haven’t enforced it previously then your claim against them is subject to dismissal.
