Yeah I'm pretty sure Max wouldn't turn down a numbers advantage by telling people who wanted to mutiny to his tribe that he would vote them out if they did.

In three tribe seasons I think it goes away when they go down to two tribes which makes sense other wise you basically won't see one tribe at all each episode.
