I disagree that "any regular intelligent human" would make a scene when a flight attendant calls them out on switching seats before take-off.

A friend of mine is an FA, a purser, and says it *is* her decision if someone gets thrown off a plane. The safety of the cabin is her responsibility, and she's done that very thing. She informs the Captain, but it's her call to get them bounced.

It's common here in Canada. The seats are considered an upgrade, and they charge a fee. Also you have to be willing to take control of opening the exit door in an emergency, so very elderly or infirm people would not be seated there.
