This was a civil case. She claimed that she was “socially isolated and socially reticent” as a result of the ordeal, and was seeking damages. She took the stand, opening her up to cross-examination. The photos directly contradicted her claims.

You may want to read up a bit on the details of the case and rulings - it was the plaintiff who claimed she was “socially isolated and socially reticent” (the claim in question for which she was seeking damages and why the photos were admitted). The photos showed otherwise. Being a civil case and given her claim, they

And from what I read from the writers and commenters on this site, I’d say the vast majority of people here would agree that clothing choice most certainly is a form of personal expression.

The clothing could be relevant to her claim of being “socially reticent”, if one considers clothing choice a form of personal expression.

“How can someone going to a party a year after a gang rape be used against them? So, she wasn’t destroyed enough to stop attempting to have a normal life so fuck her and her case?”

“Her council seems confident in the applicability of my definition.”

Since you seem so confident in the applicability of your definition, I’ll make this easy for you: in which specific jurisdictions does your specific definition apply, and in which specific jurisdictions does your specific definition qualify what this man specifically did (with regard to ‘deception’) as rape?

“...which implies the belief this could never be considered rape.”

The OP said “this isn’t rape” - they didn’t say “this could never, no how, no way be rape” in the comment to which you replied. They were talking about this specific story, which took place in a specific jurisdiction. You provided a legal definition (without citing a source) that does not apply to this story, implying

If you’re going to argue about the legal definition and whether or not it applies here, you might want to look up the (applicable) legal definition in the jurisdiction where the incident occurred and the case would be tried.

This is how FS is all the time. This is what he does - same M.O. as always. I’m surprised he hasn’t accused you of ridiculing him for his disability yet.

“different countries have different laws and regulations about it.”

This woman seems confused - the case has not gone to trial yet.

“So, despite the no contest plea, he has not taken any real responsibility for his actions and uses vague, distancing language when he speaks of his crime.”

...so where do you put your money...?

From what I’ve seen (in the comments here), people are criticizing her for the way she is doing it in this specific example - not for her trying to do something in general (by other means / in other examples).

“Women are better than men” is a stupid thing to say.
