It costs more than just publishing it on the Switch or 3DS. That costs effectively nothing, buying new cartridge parts costs money.

I’m not sure this would necessarily work for ones like that, just games where the original developers closed up shop in the 90s or earlier and there's no decent paper trail of who owns what. If Nintendo knew who owned a SNES game in 2007 for the Wii VC, they should be able to easily determine who owns it now.
