That data blaming pedestrian error is by and large based on statements made by drivers, who have an obvious motivation to blame the dead pedestrian. Dead pedestrians who (also obviously) cannot defend themselves.

The best way to protect pedestrians (and bicyclists, motorcyclists, and fellow motorists) is to pay attention, stay within sensible limits, and therefore not hit them. Sadly, this seems beyond many of us.
