the fraud argument stems from a clause in the contract. The contract, in order to use the tool, states that WB can only use it on works that they own. By using it on works that they don't own, they are claiming to represent those works. That is fraud.

the DMCA doesn't talk about companies like Hotfile being required to provide a tool. The tool is a way for hotfile AND the copyright holders to save time, and therefore money, in searching for and removing copyrighted material. Warner could just as easily sue hotfile / its users for every file but that's going to take…
