The basis for your argument is incorrect. If a player slides into your legs and you jump to avoid contact it can still be a foul on the tackler. If there was no shot on the ball and he impeded your movement then its still a foul whether you fall on the player or not.

If you have to jump to avoid having your leg broken, its still a foul. Any reasonable player would try to not take contact on that goal opportunity. He tries to cut back and gets the fouled.
