I'm not convinced that that is true. No one has proven that it actually is. And if it IS true, then why don't publishers simply go around the middlemen and find ways of providing NEW games for the same price as used ones? Atleast then they would be making some money instead of losing it all to used game sales.

If one is planning to tinker around with the IP system then why bother with half-hearted measures? The problem with the patent system is that it effectively permits some party to become a defacto monopolist over some idea. Arbitrarily designating some form of IP a patent or a copyright protection does not change this…
