If anyone still thinks a very old format that has been tried numerous ways is somehow new and going to somehow work better now than it has before without any fundamental changes to said format, they are an idiot.

That’s the point of tort laws. It keeps these frivolous suits from clogging the courts and causing headaches for everyone just so attorneys can get rich. If a suit has merit, the concern for these costs/fees goes away - because they will be paid by the “loser” of the case - and the case will be brought to court.
