If anyone still thinks a very old format that has been tried numerous ways is somehow new and going to somehow work better now than it has before without any fundamental changes to said format, they are an idiot.
That’s the point of tort laws. It keeps these frivolous suits from clogging the courts and causing headaches for everyone just so attorneys can get rich. If a suit has merit, the concern for these costs/fees goes away - because they will be paid by the “loser” of the case - and the case will be brought to court.
That is NOT what the MVSRA protects against.

It’s not just here - there’s at least 40% of the country that think/act like this. If you don’t agree with them, you’re wrong! Even if you’re actually right and supported by facts and figures or if the subject matter is purely subjective in nature.

Even if the lug nuts were not re-installed, that would not matter. That is negligence, not fraud. As soon as one tire was removed from its original location and put in another, the MVSRA-based defense was voided.
