I totally agree with you on what we wish they did. It just gets so tricky because one way a company (lets say not as big as MSFT) has a right to defend their IP but in the same light its so hard to craft language that either fails to protect or kills other people that someone always gets shafted. =(

Its just the same if someone starts making Star Wars Replicas and sells them. They would get sued. You're profiting off someone else's IP.
