Because I am passing someone, moving at speed WITH TRAFFIC in said passing lane and don’t move for some asshole tailgating me because said assholes invariably swerve and weave around, so moving over almost always means moving into him as he tries to make a reckless high speed pass?

I’m not defending the brake check. But tailgating assholes are unpredictable. I let them go around, then when I don’t have an unpredictable asshole tailgating me, I’ll move over as it is safe to do.

I’m talking about when I’m passing someone (and going with the flow of traffic in said passing lane) and some asshole comes up tailgating. I don’t have a lot of choice in terms of getting over “before it’s critical”

Rules of the road require me to move over when it is safe to do so. When I’m passing, it isn’t safe to move over when there’s a tailgating asshole swerving through traffic.

Nope. Only breaking the law if it is safe for me to move to the right. I’m never in the passing lane except to pass, and will move over as soon as it is safe. It isn’t safe to move over with a tailgating asshole who will likely make a rapid move into the adjacent lane *before* it is even safe for me to move over.

I always drive in the right lane and move to the left only to pass. That’s what I’m talking about here. I’ve moved over to pass, am keeping up with traffic flow in that lane and the asshole is still tailgating.

No, I am not. I am perfectly allowed to use the passing lane to pass someone. I’m not sitting in the passing lane at ALL *unless* as I’m passing some asshole starts tailgating me. They’re likely to cut off the traffic on the right to fly around *before* it is even safe for me to move over.
