First degree murder generally requires premeditation which doesn't seem to be a factor here. Personally, I think it's way too early to predict what'll happen here.
Murder 1 = I've been sitting around planning for days/weeks to kill your ass
Murder 2 = I wanted to kill you, but I didn't pre plan it
Manslaughter = I didn't plan or mean to kill you, but something negligent or circumstances made me
Generally speaking (and I do not practice in Michigan), first-degree murder is most apprpriate when you have some evidence that the defendant planned the murder. In this case, I think the prosecutor is hedging his/her bets. They are going with the charge that has a higher possibility of conviction.
