SCOTUS absolutely loathes non-law enforcement Federal agencies. There’s almost no chance they side with the FDA on this (or anything).
Well, Congress should change it. But I’d disagree with any SCOTUS ruling that upheld it, because as the article says, “the law hasn’t been considered constitutional or enforceable for decades.”
