The rear subframe isn’t that important for crash testing. Regardless, more deformation actually gives you better scores (to a point, obviously) because the energy is being absorbed instead of transferring to the occupants

I believe that’s case by case and if they can show documented proof (simulations, internal testing, etc) then they may not be required.
