No — the fact that they say it’s not a true Lightning or SVT is not going to be enough to make this not infringement. They’re using the mark, and they’re not Ford (or, I assume, a licensee). It’s going to be shut down.

Unfortunately, no, it’s not. Nor is it a gray area. The reason for protecting trademarks is that there is a public policy interest in making sure that brands accurately indicate the source of a product. As such, owners of a brand are required to police their marks (i.e., stop any unauthorized uses of the marks)

Unfortunately, I’m afraid that (if Ford didn’t already know about this) you almost certainly just put this dealership in an impossible position with Ford, who is going to have to ask it to remove the SVT and Lightning badging in order to avoid adverse impacts against its trademarks on those brands.

Car was a loss. But, any adult needs to have judgment enough not to destroy something of someone else’s just because it’s a total loss. Now, this guy probably will.

Agreed. Seems like it will be a fusion of Lexus and FR-S that ends up being ... a slightly different looking Z with a turbo engine. I mean, not that that is so terrible. However, I can’t figure out how it could be true, because to find the limits on my car (328xi) shod with high performance all-seasons, I literally have to be driving like a damned madman. Wink-wink

I’d love to see this same test comparing the high performance summers to high performance all-seasons. To me, if you are finding the limits on a set of high performance all-seasons (hell, even decent grand touring all-seasons), you’re driving like you robbed a bank.
