Twitter is a horrible place to think out loud.

All the fanboys don’t understand this. The SEC isn’t just going shrug and laugh it off like missing a production target. The SEC can lay down the law!

Well as CEO you clearly can’t make an announcement that you are thinking about going private without evidence to back up that you actually could. It is a pretty clear cut case of stock price manipulation at that point and is illegal for good reason. 

I would normally say the latter. Regardless of what was actually said on twitter, 280 (140 or whatever the limit is) characters does not make a good platform for any type of major financial announcement.

What’s that I hear in the distance? I think it’s the sound of 1000s of stampeding lawyers rushing sue Tesla on behalf of short seller clients. He better find that funding real quick! The SEC will be the least of Tesla and Musk’s worries...

Yes, but there are some well baked rules about this stuff.

Usually, companies have financing lined up BEFORE such an announcement.
