Pretty much. This isn’t a new thing; cases regarding this have come up before. Gaylord v US is a case where the USPS licensed a photo of a sculpture called The Column, part of the Korean War Memorial. The sculpture itself was not licensed, and Gaylord, the sculptor, sued. He prevailed.
