In some sense, bigotry is a mental illness: in appropriate generalizations, paranoid ideation, etc. On the other hand, David Duke was never in a mental hospital and ran for US President.

If I offer you a joy ride in my boat, then very few rules/laws apply. If I CHARGE you for a ride in my boat, then all sorts of laws come into play regarding registrations, safety, emergency equipment, inspections, etc.
