You're getting that mixed up with a non-compete agreement/clause. Yes these do play a part in certain situations, however, the legal argument for unfair restriction to free labour (certainly in Europe) usually quashes them immediately.
Not always, a classic example is (company names redacted- I don't work for either, but I know about the deal): Software company targets and takes a number of an OEM's senior management staff, this lead to holdups in the OEM's production line and workflow that directly impacted on the Software company's bottom line.
