The 2012 Supreme Court case centered on the constitutionality of the individual mandate. At that time, they ruled that Obamacare (and the individual mandate) was constitutional because Congress has the ability to tax.

It’s about the individual mandate. The 2012 Supreme Court ruling upheld the individual mandate because Congress has the power to tax, but when Congress repealed the individual mandate in 2017, the lower court is arguing that since the mandate isn’t a tax anymore it’s not constitutional.

Color me cynical. This is going to be a complete dud, and the biggest disappointment felt by a liberal since my wife first saw me naked.
