Figuring the reversal rate using the numbers you want to use has the 9th coming in with roughly an 80% reversal rate, with the 8th’s rate being considerably lower at around 67%. Pretty big difference, but it doesn’t actually tell you anything about whether the circuit is out of the mainstream.

Except oopsie, the 9th circuit isn’t the most overruled circuit - you’ve been listening to Hannity, haven’t you? Contrary to what he likes to claim, both the 6th and the 11th circuits get overruled more often.
