Not quite. The situation with Tomb Raider 2 got out of hand exactly because MS and CD were being coy and stringing people along when people didn't have the patience for it.

I think it is a good thing that they're being transparent about the timed exclusivity. By keeping it simple to understand and being somewhat open about it via the little asterisk note, this completely quashes any potential uproars people might have.
