GM and BMW and others have a camera system monitoring the driver’s eyes for focus. At this point that has been established as the best in class way to ensure the driver is paying attention.

Modern cars all have occupancy sensors in the passenger seat at least in the front and a lot of them in the back now for the airbag systems.
Just put one in the drivers seat its pretty cheap and simple.
