As I understand how fanfiction works, the writers include a disclaimer with every story saying they do not intend to make money off of the derived work, so it's not copyright infringement. The 50Shades person took the fanfiction she wrote and just swapped out the names. The words are the same, not just the ideas.

That reminds me of a comment thread (on another site I didnt bookmark) where people complained about coworkers stealing food from shared fridges.
