No, you can pass a FST and fail a breathalyzer and still be hauled off to jail. Maybe you ultimately get let off, or a reduced sentence to a wet reckless or something, but you aren’t “on your way” for blowing a .05.

I’m experiencing the sting of this phenomenon right now. I am looking to buy a 2009-2012 MX-5 GT PRHT, but every single one I’ve seen has been way over book- mostly in the $17-19k range. And 2013+ models are in the low $20k’s. these cars sold new for low $20k’s!
