Just out of curiosity (and please ignore this username, I am not actually a PhiPsi Dude Bro), why do you believe that the frat has no chance of winning? There is such a thing as group libel, and a good case could be made that they were libeled far worse than Eramo was.

There I disagree with you completely. After that story was published, those kids would have been completely ostracized. Their class mates and professors would have held them in nothing but contempt. They would have had to explain to all of their friends and family that no, they are not serial gang rapists. Just that…

Is it really any different than Jezebel writers and their commenters jumping at every chance to post about the banners fraternities hang from their houses, the theme of their parties, etc etc etc?
I agree. Especially if they get a payday out of this, they may even be better off in the end than they would have been had it not happened.
Legally (and in actual fact), one does not have to be named explicitly to be a victim of libel.
“vague reputational harm”...... wow. Yeah, accusing an entire organization of committing pre-conspired gang rape as part of an initiation ritual is quite vague indeed.
