Weed is detectable for 30 days or so. He can easily have smoked in a state with legal weed (hence no crime) and then failed the test.

Actually the Court must apply the mandatory minimum. That is what was the catalyst of the Oregon stand-off (trial court sentenced the ranchers to less than mandatory minimum which the ranchers served. Then the 9th circuit reversed the “low” sentence and ordered the ranchers back to prison to serve the minimum.)

President Obama would have to recuse himself on the cases challenging the ACA or his executive orders. Therefore we would lose his vote on these issues.
