Judges usually recuse themselves from any perceived conflict of interest out of an abundance of caution. No judge wants their rulings overturned due to a technicality.

I think in this case, Marlene meant “common knowledge”. As in, she feels that it may be common knowledge that a judge has to recuse him/herself in this situation.
