I know that, but I don't think the problem lies therein. The problem is simply that, with the exception of a few states, same sex couples are not granted marriage licenses. There are plenty of clergy-members who would gladly marry gay couples and sign their marriage certificates. Repeal DOMA and the problem ceases…

But that's already the way it is, so I don't understand why we need to rewrite tax codes and laws to change the word from marriage. Your religious ceremony isn't legally binding without a marriage license/certificate anyway, which still comes from the government.

You still need to get your marriage license from a state agency in order to be recognized by the government. Churches perform blessing ceremonies but they do not have any legal implication without that piece of paper from the government.
