Well try to think of it the other way...if he walks behind the counter, takes a whopper, and walks out, would it be crazy for the restaurant to call the police on him? I don’t think so.

In this case something actually was stolen from him. I’m not saying it was an emergency worthy of calling 911, but at least there was a crime. If the restaurant wasn’t going to honor it, and he wanted it back, they were obligated to return it.
