As I said, I haven’t followed this case closely, so I don’t know what evidence is or is not alleged to be floating around. If there is evidence Rose and the accused had clearly-defined boundaries, that would of course also be relevant, and would point towards a lack of consent. The test for relevance is merely whether

That’s a fair--if very finely parsed--reading of the relevant language. Were I counsel for Rose, I would still bookmark it, though.

You’re defining probative value in a manner that would then support any past sexual activity being relevant to the question of whether any future sexual activity with anyone else was consensual. “Well she consented to sex before, so it’s more likely that she consented this time.”

To counter, it’s not necessarily probative as to whether she consented to group sex

Can someone explain how using a pseudonym might prejudice Rose?

I can see why one would read things differently from just the judge’s order (as I did). That’s one hell of a strawman by the supposedly impartial adjudicator.

Finally, the Court notes that it is extremely displeased by Defendant Rose’s renewed implication that evidence Plaintiff was “sexually adventurous with [Defendant] Rose” and drank alcohol with Defendant Rose on the night in question in any way affects whether Plaintiff consented to group sex with Defendants Rose,

I’m a writer. Why not me?

It doesn’t matter if they got Ferguson wrong.

So what’s the deal? Are state and local LEOs just the JV clowns that the feds wouldn’t touch with a ten foot pole or are they a bit liberal in sending lead down range when the person in question doesn’t look like the officer?

I really want it to be true that he was just holding a book.

No one (outside of the always existing fringe) blame all police

Indulging the police account for a moment, the claim is not merely that he was armed, but that he was armed and advancing despite multiple warnings to drop the gun. Open carry doesn’t address most of that.

Update to the article includes a source stating it was civilian-on-civilian violence, i.e., no cops involved.

It seems perverse to me that you are openly rooting for the police to have murdered an innocent man rather than have engaged in the justified use of force.

At the point where someone has been killed, and multiple instances of looting are reported, it no longer seems appropriate to call it a “protest.”

Because USA Hockey consciously and publicly eschewed icing the most talented roster possible in order to specifically focus on beating Canada, and it blew up in their faces.

“It’s disappointing. It’s almost to say that we were coasting or don’t care, weren’t representing our countries as well as we could have and for other guys that have worn the jersey, it’s disappointing,” Team USA forward David Backes said

The Kings also have a coach who uses physicality to get the puck back, rather than just to intimidate the opponent for “grittership.”

Little Column A, little Column B. There is a history of ad hoc international hockey competitions--the Canada Cup started up in the 70's and was reconfigured into the World Cup in 1996--but they aren’t held with the same regularity as, say, the Olympics or FIFA World Cup (last one was in 2004).
