As an attorney, I can tell you that even large companies do occasionally do just that: jump headfirst into something without consulting any lawyers. It’s often my job to clean up after them when they do.

Copyright lasts a lot longer than that. Under the Copyright Act, a work created on or after January 1, 1978 is protected for life plus 70 years or 95 or 120 years, depending on the nature of authorship.

The likeness question to me is the interesting angle to this: whether a particular dance movement can be considered inseparable from the person who performed it to the point that selling an animation using the dance is considered misappropriation of the dancer’s likeness. I haven’t researched it, so I don’t know if

You’re right that copyright attaches the moment the work is created. However, registering a copyright gives more legal protection to it (notice to others, presumptive ownership in court battles, etc.)
