A ‘deadly weapon’ for the purposes of law enforcement and prosecution is not defined by what it is, but by what it does. If you use something to inflict bodily harm upon someone and it is reasonable to believe that the something has lethal potential, then that something is a deadly weapon.

Thats the beauty of the law. It’s open to interpretation. I’d expect the same treatment if I found someone allergic to peanuts and intentionally gave them a peanut.
