You do know we already allow the confiscation of property based on an accusation right? If you are accused of a gun crime, a judge has a right to order you to surrender all weapons as a condition of pretrial release.

I am a practicing criminal defense attorney. I don’t think the state met their burden in this case, but your legal analysis is laughably wrong. Go to any prison and ask how many people were put away based solely on “witness testimony from the alleged victim.” It literally happens every day.
