You do know we already allow the confiscation of property based on an accusation right? If you are accused of a gun crime, a judge has a right to order you to surrender all weapons as a condition of pretrial release.

I work as an attorney and I asked one of the sheriff deputies working as bailiffs about this case, he basically said it seems to him like the officer was trying to recreate a drug find in the most ham-fisted and illegal way possible. I am a practicing criminal defense attorney. I don’t think the state met their burden in this case, but your legal analysis is laughably wrong. Go to any prison and ask how many people were put away based solely on “witness testimony from the alleged victim.” It literally happens every day.
