It absolutely is. She doesn’t have the privilege of deciding not to take a call from the guy who is going to be the chief diplomat of the United States—a position she once held. The department has been dismantled over the last 15 months. If called on for advice, it is absurd that anybody would expect (let alone want)…

According to the lovely attorney I snuggle with at night (Attorney Without Billables), yes, it voids the contract; He cannot be a party to something he a) didn’t know about, and b) didn’t sign, leaving Cohen with a date for civil court, bar hearings, and criminal court.

Attorneys do not have the authority to bind you to any agreement without your very specific authorization.  

If he did not specifically authorize the attorney to enter into this agreement on his behalf (which would mean he would have to know about it) - then he is not a party to the agreement and he cannot enforce it.

When Cohen’s lawyer let it slip that Trump didn’t know anything about this NDA or the $130k payment all of the lawyers out there chimed in that he was an absolute moron because if true it would mean that the NDA was essentially voided AND that Cohen had committed fraud and could face disbarment.
