There was a decent chance of the dashcam car hitting the gold car, and we agree in that case that the gold car would have been at 100% fault. That accident would most likely have been minor though.
And in that case, the merging car would be 100% at fault. But I think the dashcam driver had the presence of mind to use the shoulder to avoid an accident, even though he would have been really pissed about it.
Having lived in California, I have seen both good and bad examples of lane splitting. This was an extremely bad one, and the motorcyclist was substantially at fault here.

I had a WRX that I chipped with Cobb Tuning and drove hard for five years from 2004-2009. Ran beautifully and without any problems despite how hard I drove it.
