If it was significant in the prosecution case somehow that the victim was sober and conscious, then yes, it should be a retrial. Or if the law prescribes different punishments depending on the victim’s drunkenness. It’s a retrial, not an acquittal.

Well, guy finding his conscience and trying to eliminate the evil he himself helped creating doesn’t sound too bad, and requesting that he steps down because of that is a dickish move. But then he clearly crossed the line with lying and firing those people.
