Actually, you can have consensual relations with someone who is technically your subordinate, it is exceedingly difficult but workplace and personal dynamics can be separate.

I’m pretty much always going to side with the employee who possesses the injury over the employer when it comes to determining whether or not the injury was preexisting. Particularly in a sport where everyone is mangled all the time.
In a sense, since your employer dictates which medical plans are feasible for you, and those plans restrict which facilities are available to you, the boss picks a pool of doctors for most employees in America.
It isn’t discrimination, but it appears to enable discrimination, and it is far easier to shoot a middle man than actually combat discriminatory behaviour. Combating that behaviour constitutes general intervention into private affairs, and would be incredibly expensive, not to mention ineffective and intrusive.
Implementation is easy and cheap, but it isn’t profitable.

I assume the numbers they were using for LeBron haven’t changed in a very long time, possibly even before he stopped growing, and may have been rounded at some point to boot. In fact, if some of the players didn’t measure higher than they used to, I would have even less reason to take the new measurements seriously.
