I think if you’re participating in what the medical community calls “risky sexual behaviors” you need to protect yourself. The onus should be on you to talk to your sexual partners about their HIV status and use the various protections that are available (condoms, PrEP etc) to prevent yourself from getting infected.

Criminalization only leads to people being further stigmatized for having a disease. With less stigma, we can get more people tested and on treatment.
