Not that the paparazzi should be recklessly driving (and should be charged for it), but how did it get that way to begin with? I have much more sympathy for the family if it started the paparazzi were trying to run them off the road, as opposed to say them trying to speed to avoid having thier pictures taken.

BUT if they can show it’s a pattern and she can’t prove something, it does help at attacking her credibility.
Claiming this is a pattern of extortion seems like a fairly good defense for a civil trial. If they can indeed show that she has a history of doing it.

Sure you can accidentally choke someone to death. Should it be treated as your stupidity (especially if they weren’t a threat), absolutely. I don’t really get why they didn’t go for first degree either. It’s a bit of a larger gamble (as trust me, choking moves while acknowledged as dangerous in the military aren’t always treated as such), but I assume NY let’s you charge for closely related crimes (so both first and second) without a huge requirement.
