Maybe. For her to do so she must still show up at the depo, and take the 5th on a question by question basis. Her invocation of the priviliege is only good if there is a “real possibility” of criminal prosecution — the risk cannot be imaginary, remote, or speculative.

I would just sit there and go, “I don’t know.”

Her “freedom” referes to her being under subpoena to appear at a certain place at a certain time to be deposed — for that time her freedom is limited.

Being that she has spousal privilege to not testify, making her give a deposition is kind of a joke. All she has do to is sit and say “I don’t know.” or “I can’t remember.”

It doesn’t have a social security number, doesn’t pay or file any tax forms and is not counted as part of the census.
