You are right. But in practice they could swap it out with an official model and the difference would be nearly indistinguishable. The artist can either let it be and enjoy the recognition and irony or demand they remove it, make little difference to the logo and still get nothing out of it.

At least you’ve got the option. Here in Canada it’s only releasing in theaters and in many places theaters are on enforced shutdown due to Covid.

Other than the Wii, I don’t think Nintendo has ever lined up its hardware releases alongside their competitors. NES came well after the crash. SNES came out after the Genesis. N64 came a year or two after the PS1 and Saturn. GameCube almost a couple years after the PS2.

Probably Xbox 360. Original issue RROD prone model that presumably still functions to this day due to lack of use. It did manage to destroy a copy of Fable II.
