Well, PvP has to be toggled now anyway. So if you aren't in warmode, you don't even see unfriendly players. Though those in the opposite faction still appear as orange names.

True, and I don't know where the creator is located. But I can only go by the laws and regulations I'm aware of, and can't research every single countries copyright law. But given Nintendo hasn't sued the creator, I'm assuming there isn't a legal angle here.
