Also, if this is illegal, why is it still able to exist on reddit? Why is kotaku able to show clips of it? Why is fan art allowed to exist? Why HASN’T Nintendo sent a cease and desist?

Of course they "could" but they haven't and probably won't. Making the assumption that this is American based, there is first amendment protections, and it would be an easy argument for a lawyer to argue that this is artist expression. True, and I don't know where the creator is located. But I can only go by the laws and regulations I'm aware of, and can't research every single countries copyright law. But given Nintendo hasn't sued the creator, I'm assuming there isn't a legal angle here.

I don’t even think this is a matter of copyright law, it’s a matter of Nintendo being a source of Ad Revenue for Youtube/Twitter.
